You Have Three Years to File a Claim

The statute of limitations for personal injury claims in New Mexico is three years. This means you have three years from the date of your injury to file a claim or you may lose your right to compensation. If your claim is against a government worker or agency you have only ninety days from the date of the accident to file a claim.

There are three main categories of compensation, or damages, an injury victim can pursue compensation for after an accident, economic, non-economic and punitive. Economic damages compensate for financial losses such as medical expenses or missed days at work while non-economic damages compensate for non-financial losses such as pain and suffering. Both economic and non-economic damages are called more than one name. Economic damages are also called special damages while non-economic is also called general damages due to the fact they compensate for such abstract losses.

The last type of damages, punitive, typically only go by that name and are generally the least awarded of the three. Instead of compensating the injury victim for a loss, the purpose of punitive damages is to punish the defendant, or negligent party. As such, punitive damages are usually reserved for cases where the defendant knew they actions would cause harm but did them anyway
